سنن ابوداؤد

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جو شخص ( مشترک ) غلام میں سے اپنا حصہ آزاد کر دے تو اس غلام کی واجبی قیمت لگا کر ہر ایک شریک کو اس کے حصہ کے مطابق ادا کرے گا اور غلام اس کی طرف سے آزاد ہو جائے گا اور اگر اس کے پاس مال نہیں ہے تو جتنا آزاد ہوا ہے اتنا ہی حصہ آزاد رہے گا ۔

Abdullah bin Umar reported the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم as saying: If anyone emancipates his share in slave, a fair price for the slave should be fixed, give his partners their shares, and the slave be thus emancipated. Otherwise he is emancipated to the extent of the share which he emancipated.

روایت ابن عمر رضی اللہ عنہما سے مرفوعاً مروی ہے۔ راوی کہتے ہیں: نافع نے کبھی «فقد عتق منه ما عتق» کی روایت کی ہے اور کبھی نہیں کی ہے۔

The tradition mentioned above has also been transmitted by Ibn Umar to the same effect through a different chain of narrators. Nafi sometimes said: He will be emancipated to the extent of the share which he emancipated, and sometimes he did not say these words.

ایوب کہتے ہیں: مجھے نہیں معلوم کہ «وإلا عتق منه ما عتق»نبی اکرم صلی اللہ علیہ وسلم کی حدیث کا حصہ ہے یا نافع کا قول ہے۔

The tradition mentioned above has also been narrated by Ibn Umar from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم. The narrator Ayyub said: I do not know whether the following words are part of the tradition of the Prophet صلی ‌اللہ ‌علیہ ‌وسلم or Nafi told them himself: Otherwise he will be emancipated to the extent of the first man's share.

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جو شخص ( مشترک ) غلام میں سے اپنا حصہ آزاد کر دے تو اس پر اس کی مکمل آزادی لازم ہے اگر اس کے پاس اتنا مال ہو کہ اس کی قیمت کو پہنچ سکے، اور اگر اس کے پاس مال نہ ہو تو صرف اس کا حصہ آزاد ہو گا ( اور باقی شرکاء کو اختیار ہو گا چاہیں تو آزاد کریں اور چاہیں تو غلام رہنے دیں ) ۔

Ibn Umar reported the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم as saying: If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.

ابراہیم بن موسیٰ کی روایت کے ہم معنی روایت مرفوعاً مروی ہے۔

The tradition mentioned above has also been transmitted by Ibn Umar from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم to the same effect as mentioned by Ibrahim bin Musa through a different chain.

مگر اس میں: «وإلا فقد عتق منه ما عتق» کا ٹکڑا مذکور نہیں اور «وأعتق عليه العبد» کے ٹکڑے ہی پر روایت ختم ہے ۱؎۔

The tradition mentioned above has also been narrated by Ibn Umar through a different chain of transmitters to the same effect as mentioned by Malik. In this version there is no mention of the words otherwise he will be emancipated to the extent of the first man's share. His version ends and the slave be thus emancipated, to the same effect as he (Malik) mentioned.

نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: جو شخص ( مشترک ) غلام میں سے اپنا حصہ آزاد کر دے تو جتنا حصہ باقی بچا ہے وہ بھی اسی کے مال سے آزاد ہو گا بشرطیکہ اس کے پاس اتنا مال ہو کہ وہ غلام کی قیمت کو پہنچ سکے ۔

Ibn Umar reported the Prophet صلی ‌اللہ ‌علیہ ‌وسلم as saying: If a man emancipates his share in a slave, the rest will be emancipated by his money if he has enough money to pay the full price for him.

نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: جب غلام دو آدمیوں کے درمیان مشترک ہو پھر ان میں سے ایک شخص اپنا حصہ آزاد کر دے تو اگر آزاد کرنے والا مالدار ہو تو اس غلام کی واجبی قیمت ٹھہرائی جائے گی نہ کم نہ زیادہ پھر وہ غلام آزاد کر دیا جائے گا ۱؎ ۔

Ibn Umar reported the Prophet صلی ‌اللہ ‌علیہ ‌وسلم as saying: If a man is shared by two men, and one of them emancipates his share, a price of the slave will be fixed, not more or less, and he will be emancipated by him in case he is rich.

ایک شخص نے غلام میں سے اپنا حصہ آزاد کر دیا تو نبی اکرم صلی اللہ علیہ وسلم نے اسے باقی قیمت کا ذمہ دار نہیں ٹھہرایا۔ احمد کہتے ہیں: ( صحابی کا نام ) تلب تائے فوقانیہ سے ہے نہ کہ ثلب ثائے مثلثہ سے اور راوی حدیث شعبہ ہکلے تھے یعنی ان کی زبان سے تاء ادا نہیں ہوتی تھی وہ تاء کو ثاء کہتے تھے۔

Narrated ath-Thalabb: On the authority of his father: A man emancipated his share in a slave. The Prophet صلی ‌اللہ ‌علیہ ‌وسلم did not put the responsibility on him to emancipate the rest. Ahmad said: The name Ibn al-Thalabb is to be pronounced with a ta' (and not with tha). As Shubah could not pronounce ta, he said tha.
