سنن ابوداؤد

قبیلہ عکل، یا قبیلہ عرینہ کے کچھ لوگ رسول اللہ صلی اللہ علیہ وسلم کے پاس آئے تو مدینہ کی آب و ہوا انہیں راس نہ آئی، رسول اللہ صلی اللہ علیہ وسلم نے انہیں دودھ والی چند اونٹنیاں دلوائیں، اور انہیں حکم دیا کہ وہ ان کے پیشاب اور دودھ پئیں، وہ ( اونٹنیاں لے کر ) چلے گئے جب وہ صحت یاب ہو گئے تو رسول اللہ صلی اللہ علیہ وسلم کے چرواہے کو قتل کر ڈالا، اور اونٹ ہانک لے گئے تو نبی اکرم صلی اللہ علیہ وسلم کو صبح ہی صبح اس کی خبر مل گئی، چنانچہ آپ نے ان کے تعاقب میں لوگوں کو روانہ کیا، تو ابھی دن بھی اوپر نہیں چڑھنے پایا تھا کہ انہیں پکڑ کر لے آیا گیا، آپ صلی اللہ علیہ وسلم نے حکم دیا تو ان کے ہاتھ اور پیر کاٹ دئیے گئے، ان کی آنکھوں میں گرم سلائیاں پھیر دی گئیں، اور وہ گرم سیاہ پتھریلی زمین میں ڈال دیئے گئے، وہ پانی مانگتے تھے لیکن انہیں پانی نہیں دیا جاتا تھا، ابوقلابہ کہتے ہیں: ان لوگوں نے چوری کی تھی، قتل کیا تھا، ایمان لانے کے بعد کافر ہو گئے تھے اور اللہ اور اس کے رسول سے جنگ کی تھی۔

Anas bin Malik said: Some people of ‘Ukl or ‘Urainah’ came to the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم and found Madinah unhealthy. So the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم ordered them to go to the camels (of the sadaqah) and ordered them to drink some of their urine and milk. They went there when they became well, they killed the herdsman of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم and drove off the camels. The news about them reached the prophet صلی ‌اللہ ‌علیہ ‌وسلم early in the morning. So he sent people in pursuit of them, and they were brought when they day had risen high. He ordered and their hands and feet were cut off and nails were drawn into their eyes, and they were thrown out of Harrah. They begged for water but were not supplied water. Abu Qilabah said: They were people who had stolen, killed, apostatized after their faith and fought against Allah and his Messenger صلی ‌اللہ ‌علیہ ‌وسلم.

آپ صلی اللہ علیہ وسلم نے سلائیوں کو گرم کرنے کا حکم دیا تو وہ گرم کی گئیں، پھر انہیں آپ صلی اللہ علیہ وسلم نے ان کی آنکھوں میں پھیر دیں، ان کے ہاتھ اور پیر کاٹ ڈالے، اور ان کو یکبارگی ہی نہیں مار ڈالا۔

The tradition mentioned above has also been transmitted by the narrator Ayyub through different chain. This version has: So he (the prophet) order nails to be heated and had them blinded with them, and he had their hands and feet cut off, and did not cauterise them to stop the flow of blood.

رسول اللہ صلی اللہ علیہ وسلم نے ان کے تعاقب میں کچھ مخبر بھیجے تو انہیں پکڑ کر لایا گیا، تو اللہ تعالیٰ نے اس سلسلہ میں آیت کریمہ «إنما جزاء الذين يحاربون الله ورسوله ويسعون في الأرض فسادا» جو اللہ اور اس کے رسول سے لڑیں اور زمین میں فساد کرتے پھریں ان کی سزا یہی ہے کہ وہ قتل کر دئیے جائیں ( سورۃ المائدہ: ۳۳ ) اتاری۔

The tradition mentioned above has also been transmitted by Anas. bin Malik through a different chain of narrators. This version says: The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم sent some people who were experts in tracking in pursuit of them and they were brought (to him). Allah, the Exalted, then revealed the verse about it: “ The punishment of those who wage war against Allah and his Messenger and strive for mischief through the land.

میں نے ان میں سے ایک شخص کو دیکھا کہ وہ پیاس کی وجہ سے زمین کو اپنے منہ سے کاٹتا تھا یہاں تک کہ وہ سب ( پیاس سے تڑپ تڑپ کر ) مر گئے۔

The tradition mentioned above has also been transmitted by Anas. bin Malik through a different chain of narrators. This version has: Anas said: I saw one of them biting the earth with this mouth (teeth) on account of thirst and this they died.

اس میں یہ اضافہ ہے پھر آپ نے مثلہ سے منع فرما دیا اور اس میں یہ ذکر نہیں ہے کہ ایک طرف کا ہاتھ کاٹا تو دوسرے طرف کا پیر۔ شعبہ نے قتادہ اور سلام بن مسکین سے انہوں نے ثابت سے، ثابت نے انس سے روایت کی ہے لیکن ان دونوں نے بھی یہ ذکر نہیں کیا ہے کہ ایک طرف کا ہاتھ کاٹا، تو دوسری طرف کا پیر اور مجھے حماد بن سلمہ کے علاوہ کسی کی روایت میں یہ اضافہ نہیں ملا کہ ایک طرف کا ہاتھ کاٹا تو دوسری طرف کا پیر۔

A similar tradition has also been transmitted by Anas bin Malik through a different chain of narrators. This version adds: He then forbade disfiguring. This version does not mention the words “ from opposite sides”. This tradition has been narrated by Shubah from Qatadah and Salam bin Miskin from Thabit on the authority of Anas. They did not mention the words “from opposite side”. I did not find these words “their hands and feet were cut off from opposite sides”. In any version except in the version of Hammad bin Salamah.

کچھ لوگوں نے نبی اکرم صلی اللہ علیہ وسلم کے اونٹوں کو لوٹ کر انہیں ہنکا لے گئے، اسلام سے مرتد ہو گئے، اور آپ صلی اللہ علیہ وسلم کے مومن چرواہے کو قتل کر دیا، تو آپ نے ان کے تعاقب میں کچھ لوگوں کو بھیجا، وہ پکڑے گئے، تو آپ صلی اللہ علیہ وسلم نے ان کے ہاتھ اور پیر کاٹ دیئے گئے، اور ان کی آنکھوں پر گرم سلائیاں پھیر دیں، انہیں لوگوں کے متعلق آیت محاربہ نازل ہوئی، اور انہیں لوگوں کے متعلق انس بن مالک رضی اللہ عنہ نے حجاج کو خبر دی تھی جس وقت اس نے آپ سے پوچھا تھا۔

Narrated Abdullah ibn Umar: Some people raided the camels of the Prophet صلی ‌اللہ ‌علیہ ‌وسلم, drove them off, and apostatised. They killed the herdsman of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم who was a believer. He (the Prophet) sent (people) in pursuit of them and they were caught. He had their hands and feet cut off, and their eyes put out. The verse regarding fighting against Allah and His Prophet صلی ‌اللہ ‌علیہ ‌وسلم was then revealed. These were the people about whom Anas ibn Malik informed al-Hajjaj when he asked him.

رسول اللہ صلی اللہ علیہ وسلم نے جب ان لوگوں کے ( ہاتھ پاؤں ) کاٹے جنہوں نے آپ کے اونٹ چرائے تھے اور ان کی آنکھوں میں آگ کی سلائیاں پھیریں تو اللہ تعالیٰ نے آپ پر اس سلسلہ میں عتاب فرمایا: اور آیت محاربہ «إنما جزاء الذين يحاربون الله ورسوله ويسعون في الأرض فسادا أن يقتلوا أو يصلبوا» جو اللہ اور اس کے رسول سے لڑیں اور زمین میں فساد کرتے پھریں ان کی سزا یہی ہے کہ وہ قتل کر دئیے جائیں یا سولی پر چڑھا دئیے جائیں ( سورۃ المائدہ: ۳۳ ) اخیر تک نازل فرمائی۔

Narrated Abuz Zinad: When the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم cut off (the hands and feet of) those who had stolen his camels and he had their eyes put out by fire (heated nails), Allah reprimanded him on that (action), and Allah, the Exalted, revealed: The punishment of those who wage war against Allah and His Messenger and strive with might and main for mischief through the land is execution or crucifixion.

یہ حدود کے نازل کئے جانے سے پہلے کی ہے یعنی انس رضی اللہ عنہ کی روایت۔

Muhammad bin Sirin said: This happened before the prescribed punishments (hudud) were revealed, meaning the tradition of Anas.

آیت کریمہ «إنما جزاء الذين يحاربون الله ورسوله ويسعون في الأرض فسادا أن يقتلوا أو يصلبوا أو تقطع أيديهم وأرجلهم من خلاف أو ينفوا من الأرض» سے «غفور رحيم» تک مشرکین کے متعلق نازل ہوئی ہے تو جو اس پر قابو پائے جانے سے پہلے توبہ کر لے تو ایسا نہ ہو گا کہ اس کے ذمہ سے حد ساقط ہو جائے ۲؎۔

Narrated Abdullah ibn Abbas: The verse The punishment of those who wage war against Allah and His Messenger, and strive with might and main for mischief through the land is execution, or crucifixion, or the cutting off of hands and feet from opposite side or exile from the land. . . most merciful was revealed about polytheists. If any of them repents before they are arrested, it does not prevent from inflicting on him the prescribed punishment which he deserves.
