سنن ابوداؤد

رسول اللہ صلی اللہ علیہ وسلم نے فیصلہ فرمایا: جو غلطی سے مارا گیا تو اس کی دیت سو اونٹ ہے تیس بنت مخاض ۱؎ تیس بنت لبون ۲؎ تیس حقے ۳؎ اور دس نر اونٹ جو دو برس کے ہو چکے ہوں ۔

Narrated Amr bin Suhaib: On his father's authority, said that his grandfather reported the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم gave judgment that if anyone is killed accidentally, his blood-wit should be one hundred camels: thirty she-camels which had entered their second year, thirty she-camels which had entered their third year, thirty she-camels which had entered their fourth year, and ten male camels which had entered their third year.

رسول اللہ صلی اللہ علیہ وسلم کے زمانے میں دیت کی قیمت ۱؎ آٹھ سو دینار، یا آٹھ ہزار درہم تھی، اور اہل کتاب کی دیت اس وقت مسلمانوں کی دیت کی آدھی تھی، پھر اسی طرح حکم چلتا رہا، یہاں تک کہ عمر رضی اللہ عنہ خلیفہ ہوئے تو آپ نے کھڑے ہو کر خطبہ دیا، اور فرمایا: سنو، اونٹوں کی قیمت بڑھ گئی ہے، تو عمر رضی اللہ عنہ نے سونے والوں پر ایک ہزار دینار، اور چاندی والوں پر بارہ ہزار ( درہم ) دیت ٹھہرائی، اور گائے بیل والوں پر دو سو گائیں، اور بکری والوں پر دو ہزار بکریاں، اور کپڑے والوں پر دو سو جوڑوں کی دیت مقرر کی، اور ذمیوں کی دیت چھوڑ دی، ان کی دیت میں ( مسلمانوں کی دیت کی طرح ) اضافہ نہیں کیا۔

Narrated Amr bin Suhaib: On his father's authority, said that his grandfather reported that the value of the blood-money at the time of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم was eight hundred dinars or eight thousand dirhams, and the blood-money for the people of the Book was half of that for Muslims. He said: This applied till Umar (Allah be pleased with him) became caliph and he made a speech in which he said: Take note! Camels have become dear. So Umar fixed the value for those who possessed gold at one thousand dinars, for those who possessed silver at twelve thousand (dirhams), for those who possessed cattle at two hundred cows, for those who possessed sheep at two thousand sheep, and for those who possessed suits of clothing at two hundred suits. He left the blood-money for dhimmis (protected people) as it was, not raising it in proportion to the increase he made in the blood-wit.

رسول اللہ صلی اللہ علیہ وسلم نے دیت کے سلسلے میں فیصلہ فرمایا کہ اونٹ والوں پر سو اونٹ، گائے بیل والوں پر دو سو گائیں، بکری والوں پر دو ہزار بکریاں، اور کپڑے والوں پر دو سو جوڑے کپڑے، اور گیہوں والوں پر بھی کچھ مقرر کیا جو محمد ( محمد بن اسحاق ) کو یاد نہیں رہا۔

Narrated Ata ibn Abu Rabah: The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم gave judgment that blood-wit for those who possessed camels should be one hundred camels, and for those who possessed cattle two hundred cows, and for those who possessed sheep one thousand sheep, and for those who possessed suits of clothing two hundred suits, and for those who possessed wheat something which the narrator Muhammad (ibn Ishaq) did not remember.

رسول اللہ صلی اللہ علیہ وسلم نے مقرر کیا پھر راوی نے ایسے ہی ذکر کیا جیسے موسیٰ کی روایت میں ہے البتہ اس میں اس طرح ہے کہ طَعام والوں پر کچھ مقرر کیا جو کہ مجھ کو یاد نہیں رہا۔

Abu Dawud said: I read out to Saeed bin Ya'qub al-Taliqini who said: Abu Tumailah transmitted to us, saying: Muhammad bin Ishaq transmitted to us saying: Ata reported Jabir bin Abdullah as saying: The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم fixed; and he mentioned the tradition like that of Musa; he said: And those who possess corn food should pay something which I do not remember.

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: قتل خطا کی دیت میں بیس حقے، بیس جزعے، بیس بنت مخاض، بیس بنت لبون اور بیس ابن مخاض ہیں اور یہی عبداللہ بن مسعود کا قول ہے۔

Narrated Abdullah ibn Masud: The Prophet صلی ‌اللہ ‌علیہ ‌وسلم said: The blood-wit for accidental killing should be twenty she-camels which had entered their fourth year, twenty she-camels which had entered their fifth year, twenty she-camels which had entered their second year, twenty she-camels which had entered their third year, and twenty male camels which had entered their second year. It does not beyond Ibn Masud.

بنی عدی کے ایک شخص کو قتل کر دیا گیا، تو رسول اللہ صلی اللہ علیہ وسلم نے اس کی دیت بارہ ہزار ٹھہرائی۔ ابوداؤد کہتے ہیں: اسے ابن عیینہ نے عمرو سے، عمرو نے عکرمہ سے اور عکرمہ نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کیا ہے اور اس میں انہوں نے ابن عباس کا ذکر نہیں کیا ہے۔

Narrated Abdullah ibn Abbas: A man of Banu Adi was killed. The Prophet صلی ‌اللہ ‌علیہ ‌وسلم fixed his blood-wit at the rate of twelve thousand (dirhams). Abu Dawud said: Ibn Uyainah transmitted it from Amr, from Ikrimah, from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم, and he did not mention Ibn Abbas.
