سنن ابوداؤد

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جو عورت اپنے ولی کی اجازت کے بغیر نکاح کرے اس کا نکاح باطل ہے ، آپ صلی اللہ علیہ وسلم نے اسے تین بار فرمایا، ( پھر فرمایا ) اگر اس مرد نے ایسی عورت سے جماع کر لیا تو اس جماع کے عوض عورت کے لیے اس کا مہر ہے اور اگر ولی اختلاف کریں ۱؎ تو بادشاہ اس کا ولی ہے جس کا کوئی ولی نہ ہو ۲؎ ۔

Narrated Aishah, Ummul Muminin: The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم said: The marriage of a woman who marries without the consent of her guardians is void. (He said these words) three times. If there is cohabitation, she gets her dower for the intercourse her husband has had. If there is a dispute, the sultan (man in authority) is the guardian of one who has none.

اسی مفہوم کی حدیث مرفوعاً مروی ہے۔

This tradition has also been transmitted by Aishah through a different chain of narrators from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم to the same effect. Abu Dawud said “Jafar did not hear any tradition from Al Zuhri. Al Zuhri gave him his writing. ”

نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ولی کے بغیر نکاح نہیں ہے ۔

Narrated Abu Musa: The Prophet صلی ‌اللہ ‌علیہ ‌وسلم said: There is no marriage without the permission of a guardian. Abu Dawud said: The narrator Yunus also transmitted on the authority of Abu Burdah, and Isra'il narrated from Abu Ishaq on the authority of Abu Burdah.
