سنن ابوداؤد

رکانہ بن عبد یزید نے اپنی بیوی سہیمہ کو طلاق بتہ ۱؎ ( قطعی طلاق ) دے دی، پھر نبی اکرم صلی اللہ علیہ وسلم کو اس کی خبر دی اور کہا: اللہ کی قسم! میں نے تو ایک ہی طلاق کی نیت کی تھی، رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: قسم اللہ کی تم نے صرف ایک کی نیت کی تھی؟ رکانہ نے کہا: قسم اللہ کی میں نے صرف ایک کی نیت کی تھی، چنانچہ رسول اللہ صلی اللہ علیہ وسلم نے ان کی بیوی انہیں واپس لوٹا دی، پھر انہوں نے اسے دوسری طلاق عمر رضی اللہ عنہ کے دور خلافت میں دی اور تیسری عثمان رضی اللہ عنہ کے دور خلافت میں۔

Nafi bun Ujair bin Abd Yazid bin Ruknah reported Ruknah bin Abd Yazid divorced his wife Suhaimah absolutely. The Prophet صلی ‌اللہ ‌علیہ ‌وسلم was informed about this matter. He said to him (the Prophet) I swear by Allaah that I meant it to be only a single utterance of divorce. The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم said “I swear by Allaah that I meant it to be only a single divorce. The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم restored her to him, Then he divorced her the second time in the time of Umar and the third time of Uthman. Abu Dawud said “This tradition contains the words of Ibrahim in its beginning and the words of Ibn Al Sarh in the end.

رکانہ بن عبد یزید سے یہی حدیث مرفوعاً مروی ہے۔

The tradition mentioned above has also been transmitted by Rukanah bin Yazid from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم through a different chain of narrators.

انہوں نے اپنی بیوی کو طلاق بتہ دے دی پھر رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئے تو آپ نے پوچھا: تم نے کیا نیت کی تھی؟ انہوں نے کہا: ایک کی، آپ صلی اللہ علیہ وسلم نے فرمایا: کیا اللہ کی قسم کھا کر کہہ رہے ہو؟ انہوں نے کہا: ہاں اللہ کی قسم کھا کر کہہ رہا ہوں، آپ صلی اللہ علیہ وسلم نے فرمایا: جس کا تم نے ارادہ کیا ہے وہی ہو گا ۔ ابوداؤد کہتے ہیں: یہ روایت ابن جریج والی روایت سے زیادہ صحیح ہے جس میں ہے کہ رکانہ نے اپنی بیوی کو تین طلاق دی تھی کیونکہ یہ روایت ان کے اہل خانہ کی بیان کردہ ہے اور وہ حقیقت حال سے زیادہ واقف ہیں اور ابن جریج والی روایت بعض بنی رافع ( جو ایک مجہول ہے ) سے منقول ہے جسے وہ عکرمہ سے روایت کرتے ہیں اور وہ ابن عباس رضی اللہ عنہما سے، ( دیکھئیے حدیث نمبر: ۲۰۹۶ )

Ali bin Yazid bin Rukanah reported on the authority of his father from his grandfather that he (Rukanah) divorced his wife absolutely; so he came to the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم. He asked (him): What did you intend? He said: A single utterance of divorce. He said: Do you swear by Allah? He replied: I swear by Allah. He said: It stands as you intended. Abu Dawud said: This tradition is sounder than that of Ibn Juraij that Rukanah divorced his wife by three pronouncements, for they are the members of his family and they are more aware for him. The tradition of Ibn Juraij has been narrated by some children of Abu Rafi from Ikrimah on the authority of Ibn Abbas.
