اگر کسی نے اپنی بیٹی کا نکاح ( وہ کنواری ہو یا بیوہ ) جبراً کر دیا تو یہ نکاح باطل ہو گا ۔

(43) CHAPTER. lf a man gives his daughter in marriage while she is averse to it (in disagreement), then such marriage is invalid.

جو دونوں یزید بن حارثہ کے بیٹے ہیں، ان سے خنساء بنت خذام انصاریہ رضی اللہ عنہا نے کہ ان کے والد نے ان کا نکاح کر دیا تھا، وہ ثیبہ تھیں، انہیں یہ نکاح منظور نہیں تھا، اس لیے رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئیں، نبی کریم صلی اللہ علیہ وسلم نے اس نکاح کو فسخ کر دیا۔

Narrated Khansa bint Khidam Al-Ansariya: that her father gave her in marriage when she was a matron and she disliked that marriage. So she went to Allah's Apostle and he declared that marriage invalid.

خذام نامی ایک صحابی نے اپنی لڑکی کا نکاح کر دیا تھا۔ پھر پچھلی حدیث کی طرح بیان کیا۔

Narrated `Abdur-Rahman bin Yazid and Majammi bin Yazid: The same ,Hadith above: A man called Khidam married a daughter of his (to somebody) against her consent. 'If you fear that you shall not be able to deal justly with the orphan girls then marry (other) women of your choice.' (4.3) And if somebody says to the guardian (of a woman), Marry me to soand- so, and the guardian remained silent or said to him, What have you got? And the other said, I have so much and so much (Mahr), or kept quiet, and then the guardian said, I have married her to you, then the marriage is valid (legal). This narration was told by Sahl on the authority of the Prophet.
