سنن ابن ماجہ

رسول اللہ صلی اللہ علیہ وسلم نے فیصلہ فرمایا: دیت عاقلہ ( قاتل اور اس کے خاندان والوں ) کے ذمہ ہے ۔

It was narrated that Mughirah bin Shu'bah said: “The Messenger of Allah (ﷺ) ruled that the blood money must be paid by the 'Aqilah.”

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جس کا کوئی وارث نہ ہو اس کا وارث میں ہوں، اس کی طرف سے دیت بھی ادا کروں گا اور اس کا ترکہ بھی لوں گا، اور ماموں اس کا وارث ہے جس کا کوئی وارث نہ ہو، وہ اس کی دیت بھی ادا کرے گا، اور ترکہ بھی پائے گا ۔

It was narrated from Miqdam Ash-Shami that the Messenger of Allah (ﷺ) said: “I am the heir of the one who has no heir, and I will pay blood money on his behalf and inherit from him, and the maternal uncle is the heir of the one who has no heir; he pays the blood money on his behalf and inherits from him.'”
