سنن نسائ

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”خریدنے اور بیچنے والا جب تک الگ الگ نہ ہو جائیں دونوں کو اپنے ساتھی پر اختیار رہتا ہے، سوائے اس بیع کے جس میں اختیار کی شرط ہو“ ۱؎۔

It was narrated from Malik, from Nafi from'Abdullah bin 'Umar that the Messenger of Allah said: The two parties to a transaction both have the choice so long as they both chosen to conclude the transaction. (Sahih )

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”خرید و فروخت کرنے والوں کو اس وقت تک اختیار رہتا ہے جب تک وہ الگ الگ نہ ہوں، یا پھر اختیار کی شرط ہو“۔

It was narrated from Yahaya, from 'Ubaidullah who said: Nafi narrated to me from Ibn 'Umar, tht the Messenger of Allah said: 'the two parties to a transaction both have the choice so long as they have not separated, or they have chosen. (Sahih )

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”خرید و فروخت کرنے والوں کو اس وقت تک اختیار رہتا ہے جب تک وہ الگ نہ ہوں، سوائے اس کے کہ بیع اختیار کی شرط کے ساتھ ہوئی ہو، لہٰذا اگر بیع اختیار کی شرط کے ساتھ ہوئی ہے تو بیع ہو جاتی ہے“ ( البتہ اختیار باقی رہتا ہے ) ۔

it was narrated from Ismail, from Nafi, that Ibn 'Umar said: The Messenger of Allah said: 'The two parties to a transaction both have the choice so long as they have not separated, unless they have both chosen to conclude they transaction. If they have both chosen to conclude the transaction, then the transaction is binding. (Sahih )

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جب دو آدمی بیع کریں تو ان میں سے ہر ایک کو اپنی بیع کا اس وقت تک اختیار رہتا ہے جب تک وہ دونوں الگ تھلگ نہ ہوں، یا پھر ان کی بیع میں اختیار کی شرط ہو، تو اگر بیع میں شرط اختیار ہو تو بیع ہو جاتی ہے ( لیکن حق اختیار باقی رہتا ہے ) “۔

It was narrated from Ibn Juraij: Nafi dictated to me, from Ibn 'Umar who said: The Messenger of Allah said: 'the two parties to a transaction both have the choice so long as they have not separated, unless they have both chosen to conclude the transaction. If they have both chosen to conclude the transaction, then the transactions binding. (Sahih )

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”بیع کرنے والے دونوں کو اس وقت تک اختیار رہتا ہے جب تک وہ الگ تھلگ نہ ہوں، یا پھر ان میں سے ایک دوسرے سے کہے کہ اختیار کی شرط کر لو“۔

It was a narrated from Ayyub, from Nafi from Ibn 'Umar that the Messenger of Allah said: The Messenger of Allah said: The two parties to a transaction both have the choice who long as they have not separated or one of them says to the other: 'Decide! ' (Sahih )

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”بیع کرنے والے دونوں کو اختیار رہتا ہے جب تک الگ تھلگ نہ ہوں، یا پھر وہ اختیاری خرید و فروخت ہو“۔ نافع کی بعض روایتوں میں یوں ہے «‏أو يقول أحدهما للآخر اختر» ”یا ان میں سے ایک دوسرے سے یہ کہے: بیع میں اختیار کی شرط کرو“۔

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”بیع کرنے والے دونوں اختیار کے ساتھ رہتے ہیں یہاں تک کہ وہ الگ تھلگ ہو جائیں، یا بیع خیار ( اختیاری بیع ) کے ساتھ ہو“۔ کبھی کبھی نافع نے یوں کہا: ” «أو يقول أحدهما للآخر اختر» یا یہ کہ ان میں سے ایک دوسرے سے کہے: بیع بالخیار کرو“۔

It was narrated from Al-Laith from Nafi from Ibn 'Umar who said: The Messenger of Allah said: 'The two parties to a transaction both have the choice so long as they have not separated or they have chosen to conclude the transaction.' Or perhaps Nafi said: Or one of them has said to the other: 'Decide! (Sahih )

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جب دو آدمی آپس میں خریدیں اور بیچیں تو ان میں سے ہر ایک کو اس وقت تک اختیار ہوتا ہے جب تک وہ جدا نہ ہوں، اور ایک دوسری بار نافع نے ( «حتى يفترقا» کے بجائے ) «ما لم يتفرقا» کہا، حالانکہ وہ دونوں ایک جگہ تھے، یا یہ کہ ان میں سے ایک دوسرے کو اختیار دیدے، لہٰذا اگر ان میں سے ایک دوسرے کو اختیار دیدے اور وہ دونوں اس ( شرط خیار ) پر بیع کر لیں تو بیع ہو جائے گی، اب اگر وہ دونوں بیع کرنے کے بعد جدا ہو جائیں اور ان میں سے کسی ایک نے بیع ترک نہ کی تو بیع ہو جائے گی۔

It was narrated from Al-Laith, from Nafi, from Ibn 'Umar that the Messenger of Allah said: When two men enter into a transaction, each of them has the choice until they separate. On one occasion he said: So long as they have not separated and one has not told the other to decide. If one tells the other to decide and they agree upon something, then the transaction is binding. If they separate after entering into a transaction and neither of them has canceled the transaction, then the transaction is binding. (Sahih )

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”خرید و فروخت کرنے والے دونوں اپنی بیع کے سلسلے میں اس وقت تک اختیار کے ساتھ رہتے ہیں جب تک وہ جدا نہ ہوں، سوائے اس کے کہ وہ بیع خیار ( اختیاری خرید و فروخت ) ہو“۔ نافع کہتے ہیں: چنانچہ عبداللہ بن عمر رضی اللہ عنہما جب کوئی ایسی چیز خریدتے جو دل کو بھا گئی ہو تو صاحب معاملہ سے ( فوراً ) جدا ہو جاتے۔

It was narrated from Yahya bin Sa 'eed who said: I heard Nafi narrating from Ibn 'Umar, form the Messenger of Allah 'the two parties to a transaction both have the choice so long as they have not separated unless they have chosen to conclude the transaction. Nafi said: ''When 'Abdullah bought something he like, he would leave straightaway.

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”خرید و فروخت کرنے والے دونوں کے درمیان اس وقت تک بیع پوری نہیں ہوتی جب تک وہ جدا نہ ہو جائیں، سوائے بیع خیار کے“۔

It was narrated from Yahya bin Sa 'eed , who said: Nafi narrated to us from Ibn 'Umar, who said: 'The Messenger of Allah said: There is no transaction between the two parties until they separate, unless they have chosen to conclude the transaction. (Sahih )
