رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جس شخص کو کوئی چیز عمر بھر کے لیے دی گئی تو وہ چیز اسی کی ہو گی اور اس کی اولاد کی ہو گی، اس کی اولاد میں سے جو اس کے وارث ہوں گے، وہی اس کے بھی وارث ہوں گے“۔

Al-Awza'i narrated from Az-Zuhri, from 'Urwah, from Jabir, who said: The Messenger of Allah said: 'Whoever is given something on the basis of 'Umra, it belongs to him and to his descendants, and is inherited by those who inherit from him.'

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”عمریٰ اس شخص کا ہے جس کے لیے عمریٰ کیا گیا، پھر اس کے بعد اس کی اولاد کا ہے، اس کی اولاد میں سے جو اس کے وارث ہوں گے وہی اس چیز کے بھی وارث ہوں گے“ ۱؎۔

(A different chain) from Abu 'Amr, from Ibn Shihab, from Abu Salamah, from Jabir, who said: The Messenger of Allah said: 'Umra (a lifelong gift) belongs to the one to whom it was given; it belongs to him and to his heirs, and is inherited by those among his descendants who inherit from him.'

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”عمریٰ اس کا ہے جس کے لیے عمریٰ کیا گیا، یہ ( زندگی بھر ) اس کا رہے گا، اور ( مرنے کے بعد ) اس کی اولاد کا ہو گا، اس کی اولاد میں سے جو اس کے وارث ہوں گے وہی اس کے وارث ہوں گے“۔

(A different chain) from Al-Awza'i, from Az-Zuhri, from 'Urwah and Abu Salamah, from Jabir, who said: The Messenger of Allah said: 'Umra (a lifelong gift) belongs to the one to whom it was given; it belongs to him and to his descendants, and is inherited by those who inherit from him.'

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جس آدمی نے کسی آدمی کو یہ کہہ کر کوئی چیز عمریٰ کی کہ یہ اس کی ہے، اور اس کے اولاد کی ہے تو وہ اس کی ہو گی، اور اس کے مرنے کے بعد اس کی اولاد میں سے جو اس کا وارث ہو گا اس کی ہو گی“۔

It was narrated from Hisham bin 'Urwah, from his father, from 'Abdullah bin Az-Zubair, that the Messenger of Allah said: Any man who gives a lifelong gift to another man, it belongs to him (the recipient) and to his descendants, and to those who inherit from him.

میں نے رسول اللہ صلی اللہ علیہ وسلم کو فرماتے ہوئے سنا ہے: ”جس نے کوئی چیز یہ کہہ کر عمریٰ کی کہ یہ اس کی ہے اور اس کی اولاد کی ہے تو اس کی اس بات نے اس کے حق کو کاٹ دیا، یعنی ہمیشہ کے لیے اس کا حق ختم ہو گیا، اب وہ چیز ہمیشہ کے لیے اس کی ہو گی جس کو عمریٰ میں دی گئی ہے، اور اس کے مرنے کے بعد اس کی اولاد کی ہو گی“۔

Al-Laith narrated from Ibn Shihab, from Abu Salamah bin 'Abdur-Rahman, from Jabir, who said: I heard the Messenger of Allah say: 'Whoever gives a life-long gift to a man, it belongs to him and to his heirs; his words (when he gave the gift) put an end to his rights over it, and it belongs to the one to whom it was given on the basis of 'Umra, and to his heirs.'

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جس شخص کو کوئی چیز اس کی عمر بھر کے لیے اور اس کے بعد اس کے وارث کو دی گئی تو وہ چیز اسی کی ہو جائے گی جسے دی گئی ہے، دینے والے کو واپس نہ ہو گی کیونکہ اس نے ایسی چیز دی ہے جس میں وراثت کا قانون جاری ہو گا“۔

Malik narrated from Ibn Shihab, from Abu Salamah, from Jabir that the Messenger of Allah said: Any man who is given a gift on the basis of 'Umra, it belongs to him and to his descendants. It belongs to the one to whom he gave it, and it cannot be taken back by the one who gave it, because he has given a gift, and it comes to the heirs of the one to whom it was given.

رسول اللہ صلی اللہ علیہ وسلم نے فیصلہ کیا کہ جس شخص نے کسی کو کوئی چیز یہ کہہ کر عمریٰ کیا کہ اس کا اور اس کی اولاد کا ہے تو یہ اسی کا ہو گا جسے اس نے عمریٰ کیا ہے، اور اس کے ساتھی سے جسے اس نے دیا ہے اللہ کے مقرر کئے ہوئے حصوں اور اس کے حق کے مطابق اس کے ورثاء وارث ہوں گے ( دینے والے کو کچھ نہیں لوٹے گا ) ۔

Shua'ib narrated from Az-Zuhri, who said: Abu Salamah bin 'Abdur-Rahman narrated to me, that Jabir told him: 'The Messenger of Allah ruled that whoever gives a lifelong gift to a man, it belongs to him and to his heirs. It belongs to the one to whom it was given, on the basis of 'Umra. It will be inherited from its recipient according to Allah's (injunctions on) inheritance and its rights.'

رسول اللہ صلی اللہ علیہ وسلم نے اس شخص کے بارے میں جسے کوئی چیز عمری کی گئی ہو کہ یہ اس کا اور اس کی اولاد کا ہے فیصلہ صادر فرمایا کہ دینے والے کو اس میں کوئی شرط لگانا اور کوئی استثناء کرنا جائز و درست نہیں ہے۔ ابوسلمہ کہتے ہیں: اس نے ایسا عطیہ دیا ہے جس میں میراث کا قانون ہو گیا اور اس کی شرط کو باطل کر دیا ( یعنی وہ شرط لغو قرار دے دی ) ۔

Ibn Abi Dhi'b narrated from Ibn Shihab, from Abu Salamah, from Jabir, that the Messenger of Allah ruled -concerning a person who has been given a lifelong gift ('Umra)- that it belongs to him and to his descendants: It is undoubtedly his, and it is not permissible for the giver to stipulate any conditions or exceptions. Abu Salamah said: Because he gave it as a gift and thus, it is subject to the same ruling as the estate, and the condition (that it will revert to the giver on the death of recipient) has become invalid.

رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جس نے کسی شخص اور اس کی اولاد کو عمریٰ کیا اور کہا کہ میں نے اسے تم کو اور تمہاری اولاد کو دے دیا ہے جب تک کہ کوئی بھی ان میں سے زندہ رہے، تو وہ چیز اسی کی ہو جائے گی جسے وہ چیز دی گئی ہے، اب وہ چیز دینے والے کو واپس نہیں ہو سکتی، اس لیے کہ اس نے اسے دیا ہی اس انداز سے ہے کہ اس میں میراث نافذ ہو گی“۔

Salih narrated from Ibn Shihab, that Abu Salamah informed him from Jabir, that the Messenger of Allah said: Any man who gives a lifelong gift to another man, it belongs to him (the recipient) and his descendants. He said: 'I have given it to you and to your descendants so long as any of you are still alive.' So it belongs to the one to whom it was given, and it cannot revert to the first owner, since he has given it as a gift, and as such, it becomes subject to the same ruling as the estate.

عمریٰ کے سلسلہ میں ایک شخص نے ایک شخص کو اور اس کی اولاد کو کوئی چیز ہبہ کی اور اس بات کا استثناء کیا کہ اگر تمہارے ساتھ اور تمہاری اولاد کے ساتھ کوئی حادثہ پیش آ گیا یا تو یہ چیز میری اور میری اولاد کی ہو جائے گی رسول اللہ صلی اللہ علیہ وسلم نے فیصلہ دیا کہ وہ چیز اس کی ہو گی جس کو دے دی گئی ہے اور اس کے اولاد کی ہو گی ( استثناء کا کوئی حاصل نہ ہو گا ) ۔

Yazid bin Abi Habib narrated from Ibn Shihab, from Abu Salamah, from Jabir, that the Messenger of Allah ruled concerning 'Umra -when a man gives a gift to another man, and his descendants, but stipulates that if something happens to you and your descendants, then it will belong to me and my descendants- It belongs to the one to whom it was given, and to his descendants.
